USER AGREEMENT

BY BECOMING A MEMBER OF OUR SITE AND/OR USING SERVICES FROM OUR SITE, YOU IRREVOCABLY AGREE, DECLARE, AND CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND ACCEPTED THE TERMS AND CONDITIONS OF THE USER AGREEMENT. THE PROVISIONS AND CLAUSES IN THIS AGREEMENT MAY BE AMENDED AT ANY TIME IN ACCORDANCE WITH LEGISLATION OR AT THE SOLE DISCRETION OF BİLETİNO.

  1. DEFINITIONS
  • Biletino: Refers to the ticketing system owned by Taglon Teknoloji Yazılım ve Ürün Gel. San. Ve Tic. A.Ş.
  • Platform: Refers to the website and all other components used by Biletino for ticket purchasers and event organizers.
  • Biletino System: Refers to all ticket sales, collection, accounting methods, and platforms currently used by Biletino and those that will be used in the future.
  • Ideas: Refers to concepts and ideas developed by Biletino for the purpose of planning the Sales Network and those that will be developed in the future.
  • Sales Network: Refers to the network of retail, call center, internet, group sales, and other sales and distribution channels that currently exist or will be added in the future, owned by Biletino.
  • Ticket: Refers to the digital code produced by the Platform and sent to Consumers via SMS, email attachment (PDF), printed paper, or other expandable methods, as well as the slips to be distributed to users who purchase tickets at the event venue.
  • Consumer: Refers to real and legal persons who wish to purchase tickets for purely personal use and without any commercial purpose for all events subject to this Agreement.
  • Customer: Refers to legal or real persons who organize events by registering as members on the Biletino Platform.
  • Event: Refers to any cultural, sporting, and educational activities, exhibitions, conferences, congresses, concerts, trainings, meetings, fairs, etc., organized by the Customer in accordance with Turkish laws.
  • Personal Data: Refers to the personal information provided by Consumers and Customers during ticket purchase and membership transactions using the Biletino System, as well as Consumer data obtained through special questions added by the Customer during the registration phase for the events they organize.
  • Venue: Refers to the location where the Event organized by the Customer will take place.
  • Event Box Office: Refers to the central box offices operating at the venue where the events will take place.
  • Pool Account: Refers to the pool account where the amounts obtained from ticket sales are held by Biletino in the contracted bank.
  • Ticket Price: Refers to the gross amount set by the Customer for the event, which they intend to collect (including all applicable state and municipal taxes).
  • Service Fee: Refers to the commission amount calculated from the Gross Ticket Price set by the Customer in exchange for the services provided by Biletino.
  • Transaction Fee: Refers to the amount that Consumers will pay for each ticket during the ticket purchase process through the Biletino system, which is added to the ticket price.
  1. PURPOSE OF THE AGREEMENT

Biletino has created an online ticket sales platform in Turkey for organizations that organize sports activities, concerts, business meetings, congresses, conferences, fairs, movie screenings, and other events, and provides intermediary services for ticket sales. The Customer is a real or legal person who organizes, facilitates, and organizes cultural, sporting, educational, business, fair, and entertainment events within the framework permitted by the laws of the Republic of Turkey. The subject of this Agreement is to arrange the terms and conditions for the Customer to utilize Biletino’s Sales Network for ticket sales of the Events they organize and for Consumers to use the Biletino platform for ticket purchasing and distribution services.

  1. PARTIES

This site user agreement (hereinafter referred to as the "Agreement") is arranged between Taglon Teknoloji Yazılım ve Ürün Geliştirme Sanayi ve Ticaret A.Ş (hereinafter referred to as the "Biletino") and the Consumer who performs the ticket purchase transaction, and the Customer with Biletino, to regulate the terms of use of the site and the rights and obligations of the User and Biletino. The Agreement is concluded between the parties upon the ticking of the relevant box indicating approval by the Customer and/or Consumer on Biletino's website and subsequent actions taken. The Consumer and Customer, by becoming members of the Platform, irrevocably agree, declare, and undertake that they have read the entire Biletino User Agreement, understood its content, and approved all its provisions. The Customer is also a party to the user agreement and can also be considered a User. The person organizing an event on Biletino may be referred to as the "Customer" in this agreement. The "Customer" irrevocably agrees, declares, and undertakes that they have read the entire User Agreement, understood its content, and approved all its provisions.

 

 

  1. SUBJECT AND SCOPE OF THE AGREEMENT

The subject of the User Agreement is the determination of the Services offered on the Biletino System, the terms of benefiting from these Services, and the rights and obligations of the parties. The User agrees, declares, and undertakes to act in accordance with any statements or explanations provided on the site.

  1. MEMBERSHIP AND TERMS OF SERVICE USAGE
  2. a) The membership process is completed once the individual wishing to become a Customer enters and submits the necessary personal information in the relevant section of the Biletino System and the registration is approved by the Biletino System. Without completing the membership process, the rights and privileges associated with being a Customer as defined in this agreement cannot be granted.
  3. b) To become a member of the Platform, one must be of legal age, have legal capacity, and must not have been temporarily suspended or permanently banned from membership by Biletino, as per the relevant clause of this agreement. If a person is underage or has been temporarily suspended or permanently banned from membership by Biletino as stated above, the completion of their registration process will not result in them becoming a member of the Biletino Platform.
  4. RIGHTS AND OBLIGATIONS

6.1. Rights and Obligations of the Customer and Biletino

  1. a) The Customer agrees, declares, and undertakes that they will act in accordance with all the terms stated in the User Agreement, the rules specified in the relevant sections of the Biletino Platform, the Privacy Agreement, and all applicable laws and regulations while completing the membership procedures, benefiting from the services of the Biletino Platform, and conducting any transactions related to the services on the Biletino Platform.
  2. b) The Customer agrees, declares, and undertakes that Biletino will be authorized to disclose their confidential/private/commercial information to official and administrative authorities if required by mandatory legal provisions in force or upon a written request from a court order or administrative law enforcement agencies, and that they will not demand any compensation from Biletino under any circumstances for such disclosures.
  3. c) The security, storage, keeping confidential from third parties, and use of the access tools (such as username, password, etc.) used by the Customers to access the Platform are entirely the responsibility of the Customers. Biletino is not directly or indirectly liable for any damages that may be incurred by the Customers and/or third parties due to any negligence or faults in the security, storage, keeping confidential, or use of these access tools by the Customers.
  4. d) The Customers declare, accept, and undertake that the information and content they provide on the Biletino Platform are accurate and lawful. Biletino is not responsible or liable for verifying the accuracy of the information and content transmitted or uploaded by the Customers to the Biletino Platform, nor is it responsible or liable for guaranteeing or ensuring the safety, accuracy, or legality of such information and content to third parties, Consumers, or Customers. Biletino cannot be held liable for any damages arising from inaccurate or erroneous information and content.
  5. e) The Customers cannot transfer their rights and obligations under the User Agreement, in whole or in part, to any third party without the written consent of Biletino.
  6. f) Biletino may provide links ("links") on the Biletino Platform to other websites, portals, files, or content owned and operated by third-party sellers, providers, or other third parties that are not under Biletino's control. These links may be provided by the Customers or by Biletino solely for reference purposes and do not imply any endorsement or guarantee by Biletino of the websites, the operators, or the content accessed through the links. Biletino is not responsible for the services, products, or content offered on or accessed through the portals or websites accessed through these links, nor for any damages that may result from such access.
  7. g) Those benefiting from the services provided by Biletino and using the Biletino Platform may only engage in transactions on the Biletino Platform for lawful purposes as required by law. The legal and criminal liability for every transaction and action taken by the Customers on the Biletino Platform rests with the Customers. Each Customer agrees, declares, and undertakes that they will not infringe upon the personal or property rights of Biletino and/or third parties by reproducing, copying, distributing, processing, or otherwise using the visual and auditory images, including music, video clips, files, databases, on the Biletino Platform, and that they will not directly and/or indirectly compete with Biletino through these actions or by other means. The Customers are fully responsible for all legal and criminal liability for activities they engage in on the Biletino Platform that violate the User Agreement or the law. Biletino is not directly or indirectly liable for any damages incurred by third parties as a result of such violations.
  8. h) Biletino and its administrators or employees are not responsible for the services provided or the content published on the Biletino Platform by third parties, including the Customers. The accuracy and legality of the information, content, and visual and auditory images provided and published by any third party or the Customers are entirely the responsibility of the individuals who perform these actions. Biletino does not guarantee or warrant the security, accuracy, or legality of the services and content provided by third parties, including the Customers.
  9. i) The criminal and legal liability for any transactions and actions performed on the site by individuals who have obtained others' information, whether legally or illegally, rests with the natural or legal persons who perform these actions. Biletino is not liable for any criminal or legal liability towards third parties, Customers, or other users due to such actions. After purchasing a ticket on the site, the Customers do not have the right or authority to cancel, withdraw, or transfer their ticket to another third party or Customer, whether for a fee or free of charge. Therefore, Biletino is under no obligation to refund the money or exchange it for another event, and Biletino will not be held liable for any financial or moral liability to third parties or Customers. However, if an event announced by the Customer is not held or cannot be held on the specified date for any reason, Biletino will initiate the refund process within 7 (seven) business days through the payment methods used by the Consumers, provided the Customer pays the refund amount of ₺10+VAT and 4%+VAT of the sold ticket price for each ticket purchased by Consumers within 2 (two) days of notification. If no notification regarding the event or Customer is received within the specified time, the event will be considered to have occurred, and the revenue will be transferred to the bank account specified by the Customer in the relevant section of the Platform using the predetermined methods. If the Customer has not entered the bank information in the relevant section of the Platform, the Customer agrees, declares, and undertakes that the money transfer will be made on the first business day after 7 (seven) days from the registration date.
  10. k) Biletino is not liable for any criminal or financial liability towards users or third parties due to the cancellation, postponement, change of date, or failure to hold the event as announced by the Customer for any reason. Biletino is not responsible for any financial or moral damage that may occur to Consumers or third parties at the event venue for any reason. Biletino has no criminal or legal liability towards third parties, Customers, or Consumers regarding how the event is conducted, the reason for the event, how the event will proceed, or the behavior and conduct of the participants during the event.
  11. l) Biletino does not guarantee or undertake that the Biletino Platform will be error-free or uninterrupted or that specific results will be obtained from using the Biletino Platform or its content. Furthermore, Biletino does not provide any express or implied warranties or guarantees, including fitness for a particular purpose, uninterrupted continuity, updates, functionality, accuracy, or error-free operation within the scope of the services provided on the Biletino Platform. The Biletino Platform and its content are provided "as is." Biletino also does not guarantee that the files uploaded on the Biletino Platform are free of viruses or contaminants or that they do not contain destructive features. Biletino does not undertake any express or implied warranties or guarantees regarding the commercial value of the Biletino Platform. Biletino cannot be held liable for any damages resulting from the use of the Biletino Platform.
  12. m) Biletino reserves the right to change the services and content provided on the Biletino Platform at any time, place a "blog" on the Biletino Platform, and restrict or delete the information and content uploaded by the Customers to the Biletino Platform, including the Customers, and to block access to third parties. Biletino may exercise this right without any prior notice or warning.
  13. n) If the Site Usage Agreement is violated by Biletino, Biletino may terminate the access of the relevant Customers to the Platform services, prevent them from using the Biletino Platform in the future, cancel ticket/invitation/participation right orders, and/or pursue all legal remedies against the individuals involved.
  14. o) The Customers agree, declare, and undertake that they will not engage in transactions that facilitate money transfers between their own accounts on the Biletino Platform or accounts belonging to acquaintances and that they will not manipulate the operation of the Biletino Platform. Otherwise, they agree, declare, and undertake that they will compensate Biletino for any damages incurred.
  15. p) Biletino has the right and authority to promote its services on the Biletino Platform as it deems appropriate and to adapt and/or modify the Biletino Platform. The rules and conditions that Customers are required to comply with regarding these changes and/or adaptations are announced to the Customers by Biletino on the relevant service's usage information page.
  16. r) Biletino will calculate a Service Fee of ₺10+VAT and 4%+VAT (Payment Systems Commission) of the Ticket Price set by the Customer (including all applicable State and Municipal taxes) for each paid ticket on the Event organized by the Customer, and will deduct it from the Customer's account in the Pool Account. The invoice for this Service Fee will be sent to the email address registered by the Customer on the Biletino Platform as an e-invoice/e-archive. If the necessary details for issuing an invoice, such as the company name, registered address information, tax office, and tax number in the case of a legal entity, or TC identification numbers and residential address information in the case of an individual, are not recorded, it is deemed that Biletino has the right not to make any payments to the Customer until the information is recorded.
  17. s) Biletino has the right to offer discounts of up to 25% on ticket prices for the event to be used in agreements and campaigns with institutions. The Organizer agrees, declares, and undertakes that they will not request any fee from Biletino for sales made at this rate and will not suspend, cancel, or close the sales of the relevant ticket category in a way that would prevent the event from being sold, and in case of such occurrences, they will compensate Biletino for any damages incurred. This section outlines the respective rights and obligations of both the Customer and Biletino in detail, covering various scenarios related to the use of the Biletino Platform and services, including liability, the accuracy of information, event cancellations, and the handling of sensitive information.

6.2. Rights and Obligations of the Customer

"The Customer may also be a Consumer, but as a Customer, they irrevocably agree, declare, and undertake to comply with the following terms and conditions."

  1. a) The Customer is a natural or legal person who organizes paid or free events using the Biletino Platform services for their own invited guests and/or for the participation of all Biletino Platform Users.
  2. b) The Customer irrevocably agrees, declares, and undertakes that they fully accept the terms of use stated in this agreement.
  3. c) The Customer irrevocably agrees, declares, and undertakes that they will not organize illegal events through the Biletino Platform and that they will conduct every event in accordance with the legal regulations, the terms they have committed to, and all the conditions they have publicly announced. Otherwise, they accept all criminal and legal liability towards third parties, Customers, or Biletino.
  4. d) The revenue obtained by the Customer from ticket sales will be transferred to the bank account specified by the Customer in the relevant section of the Biletino Platform on the 5th business day after the event takes place, provided no objections, complaints, or reports are received from Consumers or identified by Biletino. If the Customer cancels the event for any reason, the collected revenue will be refunded to the Consumers who purchased tickets for the event through their respective payment methods. The Organizer holds all responsibility towards Consumers in this matter.
  5. e) The Organizer agrees and undertakes to issue retail sales receipts, tickets, and/or invoices to Consumers in accordance with the financial regulations as a result of sales made through the Biletino System. If it is determined that the Organizer has not provided these documents to the Consumers in compliance with the financial regulations, the revenue transfer will not be made, and Biletino will notify the Customer via the email address provided in the Biletino System. If the Organizer fails to deliver these documents to the Consumers within 5 business days after the notification, a refund will be made to the Consumers, deducting the service fee. The Organizer agrees and undertakes to indemnify Biletino for any damages arising from the failure to deliver and/or prepare the financial documents for the Consumers.
  6. f) Ticket sales and participation requests for events will continue until the capacity specified by the Organizer is reached or until the event's start time. Once the capacity specified on the event page is reached and/or the event has started, the sales and reservation services provided on the event page through the Biletino System will end.
  7. g) The legal and criminal liability towards Users and third parties concerning the event lies with the Organizer.
  8. h) Biletino is not legally responsible for any transactions resulting from the purchase and sale of tickets. Biletino has no responsibility for this online sale made by the Organizer and the consumer rights associated with it; the Organizer is solely responsible for these matters. The Biletino System is merely a platform that announces events and facilitates ticket sales, and Biletino is not a party to the ticket purchase and sale transactions of Users.
  9. i) Since ticket sales for events are conducted through the Biletino System for the participation of Users, Biletino is not a party to the sale transaction and has no criminal, legal, material, or moral compensation liability towards Consumers, Customers, or third parties.
  10. j) The ticket prices listed on the Biletino System are entirely determined by the Organizer. Biletino has no influence or authority over ticket prices.
  11. k) Biletino reserves the right to charge additional fees (such as courier fees, processing fees, delivery fees, etc.) for the services provided to Consumers during ticket sales related to the event on behalf of the Organizer. Biletino will collect the service fee it has determined for each ticket sale by adding it to the ticket price.
  12. l) To transfer the revenue obtained on the Biletino System to the accounts registered by the Organizers in the Biletino System, the minimum amount must be ₺50 (including taxes).
  13. m) To organize a paid event on the Biletino System, each event must have a minimum capacity of 5 people, and ticket prices must be at least ₺5. Events cannot be organized below these limits.
  14. n) For events with a capacity of 5 people and a minimum price of ₺5, if the full capacity is not sold and the event takes place, the event will still be considered canceled, and the ticket prices paid by the Consumers will be refunded, except for the service fees. In this case, the Consumer cannot request any refund from Biletino. The risk assessments for such events are the responsibility of the Consumers.
  15. o) Ticket Advertisements: The advertising rights of all tickets sold through the sales network created by Biletino and sent to Consumers belong to Biletino. Biletino has no obligation to inform, obtain approval, and/or seek permission from the Customer regarding the advertisements placed in these areas. Biletino agrees, declares, and undertakes to act in compliance with the relevant laws and regulations concerning the use of advertising spaces.
  16. p) Full Ticket Access and Exclusivity: The parties agree that the Customer grants Biletino the right to sell tickets made available to the general public through the sales network created by Biletino, as accepted in this Agreement.
  17. r) Service Fees and Other Charges: The parties agree that Biletino has the authority to determine the service fees to be charged to Consumers for all tickets sold through the Sales Network, including those sold through Main Box Offices, unless otherwise specified in the Appendix. Biletino reserves the right to charge, collect, and demand additional fees (such as courier fees, order fees, delivery fees, processing fees, ticketing fees, etc.) under any name for the services provided to Consumers during ticket sales related to the event.

The Customer agrees and declares that by using the Biletino system, Biletino only provides a ticket sales intermediary service for the Customer, and Biletino is not responsible for any legal or tax obligations that may arise as a result of transactions made through this system. The Customer agrees to compensate Biletino for any damages caused by failure to fulfill these obligations.

  1. s) Postponement and Cancellation of Events: If any event organized by the Customer is postponed, canceled, or one or more of its performances is not completed for any reason after ticket sales for the event have started (including the Customer's breach or force majeure), the parties agree that the following provisions will apply.
  1. For each ticket sold through the Sales Network that is invalidated due to cancellation, postponement, or the non-completion of a performance of the Event, including but not limited to Force Majeure reasons, or for cases where tickets need to be canceled because the Consumer cannot attend the Event on the new date due to its postponement, Biletino is not obligated to make any payments or refunds to the Customer for the invalidated tickets ("Invalid Ticket").
  2. Biletino agrees to refund the amounts collected from Consumers for Invalid Tickets.
  3. The Customer will announce the cancellation of the event and the related refund procedure and policy on their website and social media accounts. The Customer must obtain Biletino’s approval for the content of these announcements.
  4. For each Invalid Ticket sold through the Sales Network, the Customer will pay Biletino a Cancellation Fee of ₺10 + VAT and a percentage of 4% + VAT for virtual POS and credit card fees incurred during the period up to the cancellation of the event.
  5. All costs related to the promotion of the event, including those incurred by Biletino and its employees up to the cancellation date, will be paid by the Customer to Biletino in cash and in full.
  1. t) The Customer agrees to act in accordance with their obligations under the relevant legislation regarding the processing of consumer data, which will be transferred to them by Biletino. They commit not to process personal data in violation of the law. The Customer will take all necessary technical and administrative measures to ensure an appropriate level of security to prevent unlawful processing of personal data, access to personal data unlawfully, and to ensure the retention of personal data in accordance with Article 12 of the Personal Data Protection Law No. 6698. The Customer will retain personal data processed under this Agreement for the periods required by the purpose of processing and/or applicable legislation. Upon the expiration of these periods, the Customer will delete, destroy, or anonymize the personal data either ex officio or upon the request of the data subject or Biletino. If deemed necessary, the Customer commits to signing confidentiality agreements with all employees who have access to personal data and with data processors under their control to ensure compliance with obligations related to personal data. The Customer agrees to indemnify Biletino in the event that Biletino is subject to legal, administrative, or criminal sanctions or is required to compensate any damages due to the Customer’s failure to fulfill obligations under the applicable legislation or this Agreement.
  2. u) The Customer acknowledges that the site usage rules are an integral part of the user agreement, agrees to comply with these rules, and understands that failure to do so may result in the loss of rights granted by the Platform, loss of membership, account blocking, and that in necessary cases, fees may be refunded to Consumers without requiring approval from the Customer. The Customer acknowledges that Biletino may make changes to the Site Usage Rules without prior notice and accepts full responsibility for tracking these changes.

6.3. Rights and Obligations of the Consumer

  1. a) The Consumer acknowledges, declares, and undertakes that the Events listed on the Biletino Platform are published and organized by the Customers, that Biletino has no responsibility for the accuracy of the information entered regarding these events, and that Biletino cannot be held liable for any negative consequences arising from incorrect or incomplete information.
  2. b) The Consumer acknowledges, declares, and undertakes that, in accordance with applicable mandatory legislation or court orders or written requests from administrative enforcement authorities, Biletino is authorized to disclose its confidential/private/commercial information to official or administrative authorities and that no compensation can be claimed from Biletino for this reason.
  3. c) The Consumer acknowledges, declares, and undertakes that they will request the retail sales receipt or invoice for the tickets purchased through the Platform from the Customer organizing the event.
  4. d) Consumers acknowledge, declare, and undertake that the sale of ticketing services is final and that they have no right to cancellation, refund, or modification from Biletino after the purchase transaction. Consumers may transfer the tickets they have purchased using their chosen methods. The risk associated with the transfer process lies with the Consumers who carry out the transfer. Biletino cannot be a party to any negative situations arising from the transfer process. The Consumer who originally purchased the ticket subject to the transfer agrees to compensate Biletino for all material and immaterial damages caused by the transfer.
  5. e) Consumers acknowledge, declare, and undertake that even if rules are not explicitly stated on the event page for events organized by Customers, there are rules, and the obligation to learn these rules is entirely their own. For refund procedures due to not being admitted to events by Customers due to these rules, Consumers must log in to Biletino.com using the email addresses used for purchasing tickets and create a refund request through the "My Tickets" section within 48 hours of purchase. If this situation is not reported to Biletino within the specified time and manner, the Consumer will be deemed to have waived their right to a refund, and no refund will be made.
  6. f) By accepting this user agreement, the Consumer declares and undertakes that they have read, understood, and accepted Biletino's Privacy and Cookie Policy.
  7. g) The Consumer acknowledges that they will receive a digital ticket in PDF format via SMS and/or email as a result of their ticket purchase on the platform. They recognize that the reservation (PNR) numbers and QR codes on the tickets are control elements and that the security of these elements is entirely their responsibility. Although these control elements can be photographed, noted, digitally transmitted, or copied in any medium, the responsibility to verify ownership of these control elements at event entry points lies with the Consumer. All responsibility for the tickets sent by the platform rests with the Consumer.
  8. h) The Consumer undertakes to use correct and up-to-date information when purchasing tickets. They acknowledge, declare, and undertake that Biletino has no responsibility for issues arising from incorrect or outdated information related to ticket access and that they have no rights in this regard.
  9. TERMS OF USE
  10. a) The content entered in areas where text such as event names, event details, event characteristics, venue names, venue details, ticket names, ticket details, user names, user details, and user profile notes can be added on the biletino.com site and its subpages is the responsibility of the user who inputs the content. Biletino accepts no responsibility for the content written by users.
  11. b) Content that does not comply with the laws of the Republic of Turkey or international laws, agreements, and regulations cannot be published on Biletino. The user who enters such content is responsible for it.
  12. c) Provocative or derogatory visuals regarding communities cannot be used, and text content cannot be written.
  13. d) It is prohibited to publish threatening, obscene, hateful content and/or events; create events, use visuals, and/or publish text content that discriminates based on religion, language, race, or sect, or exhibits contemptuous behavior towards individuals.
  14. e) Creating or publishing text and visual content for events that are purely propagandistic and provocative, and which do not have a social event nature, is prohibited.
  15. f) It is prohibited to publish content related to the promotion of your site, advertisements for "products" sold or mediated on your site, and any commercial messages, including crack, warez, hack apps, and similar sites, under the headings of events, comments, descriptions, information, reservations, and/or details on biletino.com.
  16. g) The responsibility for checking the copyrights of visual materials added by users on biletino.com and its subpages belongs to the users and visitors. Users are responsible for the originality of the visual materials published on Biletino, ensuring that copyrights have been obtained from the creator of the work, and that they comply with the laws of Turkish Republic or international laws, agreements, and regulations. Biletino cannot be held responsible for any discrepancies.
  17. h) Biletino administrators have the right to delete profiles, events, and block accounts of users who do not comply with the rules.
  18. i) Users who do not comply with Biletino rules will be warned by administrators. However, in case of repeated behavior, Biletino administrators have the right to delete the users' profiles, events, and block their accounts.
  19. j) The ticket fees for participants who have purchased tickets for events organized by event organizers whose events have been removed due to rule violations will be refunded. However, the service fee paid for these reservations will not be refunded.
  20. k) Biletino reserves the right to update or add new site usage rules at any time. Biletino may change the site usage rules without notifying users if deemed necessary.
  21. l) Anyone who is a member of biletino.com or uses its services without membership is deemed to have read, understood, and accepted these rules.
  22. OTHER TERMS

8.1 Intellectual Property Rights

  1. a) All elements of the Biletino Platform (including, but not limited to, design, text, images, HTML code, and other codes) (works subject to Biletino’s copyright) are owned by Biletino and/or used under a license granted by a third party to Biletino. The Customer and Consumer may not resell, share, distribute, display, reproduce, create derivative works, or prepare any of Biletino’s copyrighted works, nor allow others to access or use Biletino’s Services. Otherwise, they will be responsible for covering any claims for damages, including but not limited to those made by licensors and third parties, as well as court costs and legal fees, and any other obligations.
  2. b) Biletino reserves all rights to its entire assets, including material and intellectual property rights through Biletino Services, Biletino information, Biletino copyrighted works, Biletino trademarks, Biletino trade dress, and Biletino Platform. This includes all tangible and intangible rights, commercial information, and knowledge.

8.2. Changes to the Agreement

Biletino may, at its sole discretion and unilaterally, modify this User Agreement at any time by announcing the changes on the Biletino Platform. The amended provisions of this User Agreement will become effective on the date they are announced; the remaining provisions will continue to apply and remain in force. This User Agreement cannot be altered by unilateral statements from the Customer or Consumer.

8.3. Force Majeure

In all cases legally considered as 'force majeure,' Biletino shall not be liable for any delay, incomplete performance, or non-performance of any obligations defined by this User Agreement. Such situations will not be regarded as delays, incomplete performance, or non-performance or default by Biletino, nor can any compensation be claimed from Biletino under any name for these circumstances. The term "force majeure" shall be interpreted to include, but not be limited to, natural disasters, uprisings, wars, strikes, communication issues, infrastructure and internet failures, power outages, social events, changes in election dates, and adverse weather conditions, as well as other unavoidable events outside the reasonable control of the affected party despite the exercise of due diligence.

8.4. Governing Law and Jurisdiction

Turkish Law will apply to the implementation, interpretation, and management of legal relations arising from this User Agreement. In the event of any dispute arising from or related to this User Agreement, the Istanbul Çağlayan Courts and Enforcement Offices shall have jurisdiction.

8.5. Termination of the Agreement

This User Agreement will remain in effect as long as the Customer and Consumer are members of the Biletino Platform and will continue to have effect and consequences between the parties; it will be considered terminated if the membership period of the Customer and Consumer expires or if their membership is suspended, either temporarily or permanently. Biletino may unilaterally terminate the agreement in the event that the Customer or Consumer violates this User Agreement and/or similar rules related to the use, membership, and services on the Biletino Platform, particularly in the following cases. The Customer or Consumer will be liable to compensate Biletino for all damages incurred due to the termination:

  1. a) If the Customer or Consumer engages in actions that manipulate the operation of the Biletino System using any method, or makes misleading or defamatory statements about the Biletino System,
  2. b) If the Customer or Consumer transfers or makes available their User profile created for themselves to another person,
  3. c) If the Customer or Consumer engages in acts that infringe or risk infringing upon the rights of third parties,
  4. d) If the Customer organizes or attempts to organize illegal activities,
  5. e) The organization of fictitious events by Customers and/or attempts to organize such events.
